Thanks for visiting Perspective Wellness, Inc. (“we”, “us” or “our”) respects your privacy. When it comes to your personal information, we believe in transparency, not surprises. That’s why we’ve set out here what personal information we collect, what we do with it and your choices and rights.

By visiting Perspective Wellness, you confirm you have agreed to and read and understood this Privacy Policy and understand that we use cookies on our website to see how you interact with it. By accepting, you agree to our use of such cookies.

How does this Privacy Policy apply?

This Privacy Policy describes what we do with personal information that we collect and use for our own purposes (i.e., where we are a controller), such as your account information and information about how you use and interact with our on-line store.

Personal information we may collect and/or that may be collected by third parties:

We may collect various personal information regarding you or your device. This includes the following:

  • Information you provide to create an Account, specifically email address, first name and last name. We receive a portion of your payment information from our payment processor (such as the last four digits, the country of issuance and the expiration date of the payment card) and we ask you to select your jurisdiction.

  • Your marketing preferences.

  • The emails and other communications that you send us or otherwise contribute, such as customer support inquiries.

  • Information you share with us in connection with surveys, contests or promotions.

  • Information from your use of the Services or Users’ sites. This includes: IP addresses, preferences, web pages you visited prior to coming to our or our Users’ sites, information about your browser, network or device (such as browser type and version, operating system, internet service provider, preference settings, unique device IDs and language and other regional settings), information about how you interact with the Services and our Users’ sites (such as timestamps, clicks, scrolling, browsing times, searches, transactions, referral pages, load times, and problems you may encounter, such as loading errors).

  • Information we get from our partners to support our marketing initiatives, improve our Services and better monitor, manage and measure our ad campaigns, such as details about when a partner of ours shows you one of our ads on or via its advertising platform.

  • Other information you submit to us directly or through Third Party Services if you use a Third Party Service to create an Account (based on your privacy settings with such Third Party Service).

How we collect personal information

We obtain personal information from various sources. We do this in three main ways:

  • You provide some of it directly (such as by registering for an Account).

  • We record some of it automatically when you use our Services or Users’ sites (including with technologies like cookies).

  • We receive some of it from third parties (like when you register for an account using a Third Party Service, when you schedule appointments via Calendly, or when you make payments to us using our payment processor or via a mobile app store).

We’ve described this in more detail below:

a. Personal information you provide

When you use our Services, we collect information from you in a number of ways.  For instance, we ask you to provide your name and email address to register and manage your Account. We also maintain your marketing preferences and the emails and other communications that you send us or otherwise contribute, such as customer support inquiries or posts to our customer message boards or forums. You might also provide us with information in other ways, including by responding to surveys, submitting a form or participating in contests or similar promotions.

b. Personal information obtained from your use of our Services

When you use our Services, we collect information about your activity on and interaction with the Services, such as your IP address(es), your device and browser type, the web page you visited before coming to our sites, what pages on our sites you visit and for how long and identifiers associated with your devices. If you’ve given us permission through your device settings, we may collect your location information in our mobile apps.

If you are an End User of our Users’ sites, we also get information about your interactions with their sites, though we use this in anonymous, aggregated or pseudonymized form which does not focus on you individually. We use this data to evaluate, provide, protect or improve our Services (including by developing new products and services).

Some of this information is collected automatically using cookies and similar technologies when you use our Services and our Users’ sites. We let our Users control what cookies and similar technologies are used through their sites (except those we need to use to properly provide the Services, such as for performance or security related reasons). 

c. Personal information obtained from other sources

If you use a Third Party Service (such as Google) to register for an Account, the Third Party Service may provide us with your Third Party Service account information on your behalf, such as your name and email address (we don’t collect or store passwords you use to access Third Party Services). Your privacy settings on the Third Party Service normally control what they share with us. Make sure you are comfortable with what they share by reviewing their privacy policies and, if necessary, modifying your privacy settings directly on the Third Party Service.

If you sign up for Paid Services directly with us, we obtain limited information about your payment card from our payment processor, such as the last four digits, the country of issuance and the expiration date. Currently, our payment processor is Stripe. Stripe uses and processes your complete payment information in accordance with Stripe’s privacy policy. This paragraph is not applicable if you sign up for Paid Services as an in-app purchase via a mobile app store. Please see Google's privacy policy and Apple's privacy policy for information about how they use and process your payment information. 

How we use your personal information

We use the personal information we obtain about you for the following purposes:

  • Provision of the Services. Create and manage your Account, provide and personalize our Services, process payments and respond to your inquiries.

  • Communicating with you. Communicate with you, including by sending you emails about your transactions and Service-related announcements.

  • Surveys and contests. Administer surveys, contests and other promotions.

  • Promotion. Promote our Services and send you tailored marketing communications about products, services, offers, programs and promotions of Squarespace and our partners and measure the success of those campaigns. For example, we may send different marketing communications to you based on your subscription plan or what we think may interest you based on other information we hold about you.

  • Advertising. Analyze your interactions with our Services and third parties’ online services so we can tailor our advertising to what we think will interest you. For example, we may decide not to advertise our Services to you on a social media site if you already signed up for Paid Services or we may choose to serve you a particular advertisement based on your subscription plan or what we think may interest you based on other information we hold about you.

  • Complying with law. Comply with applicable legal requirements, such as tax and other government regulations and industry standards, contracts and law enforcement requests.

We process your personal information for the above purposes when:

  • Consent. You have consented to the use of your personal information in a particular way. When you consent, you can change your mind at any time.  

  • Performance of a contract. We need your personal information to provide you with services and products requested by you, or to respond to your inquiries. In other words, so we can perform our contract with you or take steps at your request before entering into one. For example, we need your email address so you can sign in to your Squarespace account.

  • Legal obligation. We have a legal obligation to use your personal information, such as to comply with applicable tax and other government regulations or to comply with a court order or binding law enforcement request.

How we share your personal information

We share personal information in the following ways:

  • Service providers. We share personal information with our service providers that perform services on our behalf. For example, we may use third parties to help us provide customer support, manage our advertisements on other sites, send marketing and other communications on our behalf or assist with data storage.

  • Process payments. We transmit your personal information via an encrypted connection to our payment processor.  

  • Following the law or protecting rights and interests. We disclose your personal information if we determine that such disclosure is reasonably necessary to comply with the law, protect our or others’ rights, property or interests (such as enforcing our Terms of Service) or prevent fraud or abuse of Naataq Gear. In particular, we may disclose your personal information in response to lawful requests by public authorities, such as to meet national security or law enforcement requirements.

 

Your rights and choices

Where applicable law requires (and subject to any relevant exceptions under law), you may have the right to access, update, change or delete personal information.

You can access, update, change or delete personal information (or that of your End Users) either directly in your Account or by contacting us at clinic@perspectivewellness.org to request the required changes. You can exercise your other rights (including deleting your Account) by contacting us via your Account at the same email address. Please note that we may need to verify your identity in connection with your requests, and such verification process may, if you do not have access to your Account, require you to provide us with additional information (e.g. government identification). Even if you have access to your Account, we may request additional information if we believe it’s necessary to verify your identity. If we are unable to verify your identity or request, we may not, in accordance with applicable law, be able to fulfill your request.

You can also elect not to receive marketing communications by changing your preferences in your Account or by following the unsubscribe instructions in such communications.

Please note that, for technical reasons, there is likely to be a delay in deleting your personal information from our systems when you ask us to delete it. We also will retain personal information in order to comply with the law, protect our and others’ rights, resolve disputes or enforce our legal terms or policies, to the extent permitted under applicable law.

You may have the right to restrict or object to the processing of your personal information or to exercise a right to data portability under applicable law. You also may have the right to lodge a complaint.

Additionally, if we rely on consent for the processing of your personal information, you have the right to withdraw it at any time and free of charge. When you do so, this will not affect the lawfulness of the processing before your consent withdrawal.

Please note that in the course of providing the Services, we collect and maintain aggregated, anonymized or de-personalized information which we may retain indefinitely.

Perspective Wellness, Inc.  is committed to protecting your privacy. To better protect your privacy we provide this notice explaining our online information and patient record storage practices. 

 

  • INFORMATION COLLECTION AND USE

 

We collect information about visitors to our website, www.perspectivewellness.org (Site) so that we can provide an experience that is responsive to our users' and clients' needs. We do not collect medical information or credit card information through our Site. Our Site may use forms in which you give us contact information (including your name, address, telephone number, and email address) so you can request information or support. We receive and store any information you enter on our Site, or give us in any other way, including through email, telephone, or other communications within our customer services department. You do not need to give us any personal information in order to use our Site.

 

We will not sell, share, trade or otherwise use any information you provide unless you expressly provide in writing permission for such use. We collect this information to improve our service, and to help us determine your individual needs so we may serve you better individually, as well as collectively.

Please note, to better safeguard your information, please do not include any credit card information in your electronic communication unless it is specifically required by us as part of Services or transaction fulfillment process sites, or our customer contact process.

Our site is powered by Wix.com and has security measures in place to protect against the loss, misuse or alteration of the information under our control. If our site allows you to enter sensitive information (such as a credit card number) on order firms, we encrypt the transmission of that information using secure socket layer technology (SSL).

 

We may also at times provide information about you to third parties to provide various services on our behalf, such as providers who process credit card payments (see Squarespace and Stripe, above). We will only share information about you that is necessary for the third party to provide the requested service. These companies are prohibited from retaining, sharing, buying, selling, storing or using your personally identifiable information for any secondary purposes.

 

We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is one hundred percent (100%) secure, however. Therefore, we cannot guarantee its absolute security.

 

  • GOOGLE ANALYTICS AND COOKIES

 

We may use a tool called “Google Analytics” to collect information about use of this Site, such as how often users visit the Site, what pages they visit when they do so, and what other sites they used prior to coming to this Site. Google Analytics collects only the IP address assigned to you on the date you visit this Site, rather than your name or other identifying information.

 

Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit this Site. This cookie cannot be used by anyone but Google, Inc. The information generated by the cookie will be transmitted to and stored by Google on servers in the United States.

 

We use the information received from Google Analytics only to improve services on this Site. We do not combine the information collected through the use of Google Analytics with personally identifiable information.

  • MEDICAL INFORMATION SECURITY

Records Maintenance & Storage

 

We use CharmEHR as our client electronic health records management software. This platform is HIPAA compliant and secure. Client information is only accessible by authenticated and authorized users.

 

 

We also use Google Workspace in our administration. This platform is HIPAA compliant and secure. Client information is only accessible by authenticated and authorized users.

 

 

Patient Communications

 

  • Unless another method is requested by clients, we typically communicate with clients via txt, which is operated via Google Workspace (Google Voice). Thus, all communications are protected (on the server side) by Google’s robust Workspace, HIPAA compliant security protocols.

 

Records Disclosure To Third Parties

 

  • We do not disclose any client health information without a Request Of Information (ROI) executed by the clients. Clients must have an executed ROI in order for us to collaborate with any outside professionals (eg. therapist, psychiatrist).

 

How We May Use and/or Disclose Medical Information About You

 

  • For treatment. We may use your medical information so that we and other health care providers may provide you with medical treatment or services. Different health professionals may also share your medical information in order to coordinate the different services you need. We may disclose your medical information to people outside our offices and/or locations who may be involved in your medical care after you leave our care.

  • For Healthcare Operations Purposes. We may use and disclose your medical information for our internal operations, such as business management, and administrative activities, legal and auditing functions, and insurance-related activities. We may use medical information to make sure that all of our clients receive quality care, such as reviewing our processes or to evaluate the performance of those caring for you. We may also disclose information to doctors, nurses, technicians, and other personnel for review and learning purposes. We may remove information that identifies you from this set of information so others may use it to study healthcare and healthcare delivery without learning a specific patient’s identity. 

  • Individuals Involved In Your Care or Payment of Your Care. We may release your medical information to a friend or family member who is involved in your medical care, or to someone who helped pay for your care.

  • Notification. We may release your medical information to notify a family member, personal representative or another person responsible for your care of your location, general condition, or death. We also may release your medical information for certain disaster relief purposes.

  • Contacts. We may contact you to provide appointment reminders, information about treatment alternatives, or other health related benefits and services that may be of interest to you.

  • Mental Health Information. State laws create specific requirements for the release of mental health records.We will obtain your specific authorization to release mental medical information when required by these laws.

  • Miscellaneous. We may use or disclose your medical information without your prior authorization for several other reasons. Subject to certain requirements, we may give out your medical information without prior authorization for public health purposes, abuse or neglect reporting, health oversight audits or inspections, research studies, funeral arrangements, Coroner’s investigations, organ donation, and emergencies. We also may disclose medical information when required by law in response to a request from law enforcement in specific circumstances, for specialized government functions including correctional, military or national security purposes, in response to valid judicial or administrative orders or to avoid a serious health threat. Additional specific rules may apply to mental health records.

 

Your Rights Regarding Medical Information About You

 

  • Right to Inspect and Copy. In most cases you have the right to inspect or receive a copy of your medical information (or have a copy provided to an individual whom you designate) when you submit a written request. Terms And Conditions

This website is owned and operated by Perspective Wellness, Inc. a WI non profit organization. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors [description of what is offered on your website]. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

The prices we charge for our services are listed on the website on the Pricing page. We reserve the right to change our prices for services displayed at any time, and to correct pricing errors that may inadvertently occur.

Fees And Cancellations

Fees for services are collected at the time of scheduling your Intake or KAT session (an “Event”). 

Timely Cancellation: If you cancel an Event with greater than five (5) days notice, you may reschedule or request a refund of the Fees by sending an email to clinic@perspectivewellness.org. We shall refund your Fees for the cancelled Event within 7 business days of said request, minus up to a ten (10) percent cancellation fee. If you pay for an Event and that Event does not occur within sixty (60) days of scheduling and payment, your fee shall be returned upon request, minus up to a ten (10) percent service fee.

Late Cancellation: If you cancel an Event with five (5) or less days notice and do not present a valid medical or emergency situation reason, you may reschedule or request a refund of the Fees by sending an email to clinic@perspectivewellness.org, We shall refund your Fees for the cancelled Event within 7 business days of said request, minus up to a thirty-five (35) percent service charge.

No Show: If you fail to show for an Event and do not present a valid medical or emergency situation reason, you may reschedule or request a refund of the Fees by sending an email to clinic@perspectivewellness.org, We shall refund your Fees for the cancelled Event within 7 business days of said request, minus up to a fifty (50) percent service charge.

Anti-Diversion: Any return of Fees for cancellations shall require proof of destruction of any Perspective Wellness prescribed controlled substances in your possession.

Retention of right to change offering

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

Preemption By Other Terms And Conditions

The terms and conditions set forth herein are superseded and preempted by the terms and conditions contained in any separate Medical and/or Psychological consents you have agreed to during the intake process, including, but not limited to consents agreed to electronically via our Charm EHR health portal and/or physically signed consents obtained during the treatment process.

 

Ownership of intellectual property, copyrights and logos

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Perspective Wellness, Inc.. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

 

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Perspective Wellness, Inc., be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service. To the maximum extent permitted by applicable law, Perspective Wellness, Inc. assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

 

Right to Change or Modify Terms
